Description

Description

The Air Albany apartment complex project at 1211 Western Avenue in Albany, NY, was stalled and vacant for nearly three years. The project, first approved in 2017, faced opposition from neighbors due to safety concerns and expired work permits. The City of Albany Industrial Development Agency (IDA) reached a memorandum of understanding (MOU) with the developer, DMG Investments, to address code violations and restart construction. The MOU includes obligations such as monthly updates, hiring a construction monitor, submitting a building permit application by October 20, 2025, and initiating construction within 30 days of permit issuance. The developer's deadline to submit another construction permit was extended to November 21, 2025, with construction required to start within 60 days thereafter. The project is at risk of losing $14 million in tax breaks and is involved in a lawsuit between the developer and architect. The IDA approved tax exemptions totaling over $14 million in 2020, with the project expected to generate over $8 million in local tax revenue by 2039 and create 90 construction jobs.
