Description | Objectives Identify legal and procedural strategies, blockages and best practices that can be replicated or prevented in different legal and judicial systems, therefore enabling courts to provide a more accurate and fair response. Support the improvement of legislation and policies at national and EU levels regarding business failure and insolvency, including issues related to the enforcement of cross-border insolvency rules and of enterprise groups restructuring and insolvency practices. Strength the research at EU level and promote the cooperation between academia, practitioners and economic players to reinforce mutual learning and knowledge dissemination. Activities WS1: analysis of existing national and EU documents and legislation, through content analysis, statistical data and exploratory interviews. WS2: assessing courts performance, through: a) selection of courts and analysis of court cases; b) interviews to judicial actors; c) focus groups. WS3: acknowledge the dynamics and strategies of key players, through interviews and focus groups to identify the best practices and obstacles. WS4: dissemination of findings through: final conference; final report; booklet on best practices; book or journal issue; national publications. Type and number of persons benefiting from the project Legal professionals, policy makers and regulators, judicial authorities, enterprises and academics will benefit from the project results. Plus: ‐ 4 workshops – 100 p. ‐ Final conference – 100 p.+team members+5 speakers+200p. on live streaming ‐ Min. 500 p. accessing the webpage Expected results - Increasing knowledge and awareness of obstacles and best practices ‐ Recommendations of public policy to improve insolvency law enforcement ‐ Promoting a European research network ‐ Promoting training programms Type and number of outputs to be produced 2 comparative reports, 3 articles, 4 national publications 4 workshops 1 booklet on best practices and 1 book or a journal issue |
