Description | The BR-153/080/414/GO/TO concession project was qualified at the 3rd Meeting of the PPI Council, through Resolution No. 14, of 08/23/2017, converted into Decree No. 9,972, of 08/14 /2019. THE CONCESSION The road system of this Concession is the main connection between the Mid-North of Brazil (states of Tocantins, Maranhão, Pará and Amapá) with the Center-South Region of the country, comprising a total of 850.7 km made up of Highways BR-153 /TO/GO, BR-080/GO, BR-414/GO. The sections to be granted are: Highway BR-153/TO/GO, between Aliança do Tocantins and Anápolis; Highway BR-080/GO, between Uruaçu and Assunção de Goiás (BR-414); BR-414/GO Highway, between Assunção de Goiás and Anápolis. It is worth noting that, from the fork of BRs-153 and 080, users will have the possibility of route via BR-153 itself or via BRs-080 and 414. The BR-153 highway was already granted in the past, but was returned to the management of the Federal Government due to the declaration of expiration (on 8/15/2017) of the concession of ownership of Concessionária de Rodovias Galvão BR-153 SPE S.A. – BR- 153/GO/TO, due to non-performance of the contract, under the terms of § 4 of art. 38 of Law No. 8,987, of February 13, 1995. Currently, BR-153 is considered one of the main national integration highways in Brazil. The section of this highway included in the future Concession is 624.1 km long, 598.3 km of which is single lane; 26.5 km of double carriageway with median, in addition to 9.2 km of marginal roads, of which 2.8 km are unpaved. BR-080 is 87 km long with single lanes and BR-414 is 139.6 km long with single lanes. According to the study, the Concession will directly impact 38 municipalities in the states of Tocantins and Goiás, most of which are crossed by the three highways and some of which are inserted in the “diamond” formed between Uruaçu/GO and Anápolis/GO. The investments resulting from the new concession will result in an improvement in the level of service offered, ensuring greater fluidity and reliability. They will also have a favorable impact on the safety of cargo and passenger transport, reducing the occurrence of accidents, as well as influencing travel time and logistical costs between the Mid-North and the Central-South regions of the country. The Concession will have a term of 35 years, extendable for another 5 years, and will consist of the exploration of the infrastructure and the provision of public services for recovery, conservation, maintenance, operation, implementation of improvements and expansion of capacity. It is predicted that all this investment will generate approximately 14,352 thousand direct and indirect jobs. CONSTRUCTION The Highway Exploration Program (PER) includes the mandatory duplication of 623.3 km, 357.9 km from the 3rd to the 10th year and another 265.5 km between the 19th and 25th year. The highway will also receive the following improvements: construction of 27.6 km of additional lanes, 89.9 km of marginal roads, Corumbá de Goiás bypass, 30 new uneven interconnection devices, 19 pedestrian walkways, 6 underpasses, lighting at urban crossings and marginal roads, among other improvements. An operations control center – CCO and 19 operational service bases – BSOs are also planned to support emergency medical care teams, mechanical care and response to other incidents on the road. In addition to these mandatory works, ANTT may request the eventual execution of various improvements throughout the contractual execution, if necessary, in the form of a stock of improvements available for this purpose. TOLL PLACES The highway will have nine toll plazas distributed between BRs 153/TO/GO (7 units); 080/GO (1 unit) and 414/GO (1 unit). CONCESSION INNOVATIONS For this new round of road concessions, notices will be published in Portuguese and English, favoring the participation of foreign companies. The auction's judging criteria will be hybrid, combining the lowest basic toll rate (with a discount limited to 16.25%) and the highest grant value. The notice requirements for proving technical qualifications were also simplified, favoring competition in the auction. The draft Contract brought several innovations, for example: – Differentiated tariff for single lane and double lane, bringing greater tariff fairness to the user and serving as an incentive for the concessionaire to carry out capacity expansion works. – Basic Fare Discount (DBT): discount on the toll fare for users who use electronic payment methods and automatic vehicle identification (AVI). – Frequent User Discount (DUF): discount applied to toll fees owed by frequent users of the highway, reducing the costs of people who use the highway to make frequent trips, usually between nearby municipalities, with travel distances shorter than those of the sections covering the toll plazas. – Exchange Protection Mechanism: mechanism that allows mitigating the effects of exchange rate variations on financing in foreign currency contracted by the concessionaire. – Risk Mitigation Mechanism: mechanism for mitigating the risk of tariff revenue during investment cycles, aiming to compensate the concessionaire or the Granting Authority due to significant variations in traffic expected for the concession, in order to ensure the execution of planned investments , regardless of variations in demand. – Linked Resources: amounts deposited by the concessionaire to form the Concession's contingency reserve, exclusively intended for compensating events foreseen in the Exchange Rate Protection and Risk Mitigation mechanisms, in addition to the application of the Frequent User Discount. – Improvement of risk allocation: greater detail of the risk allocation sub-clauses, aiming to provide greater clarity regarding the limits of these risks, as well as filling any gaps that could later result in arbitration or judicial challenges. – Improvements in Dispute Resolution Clauses: the clauses referring to dispute resolution mechanisms were reformulated, in order to make them comply with the legislation that deals with the subject. – Tripartite Agreement: optional agreement that provides greater security for financiers, providing information on the status of the concession and allowing the temporary administration of the concession or the assumption of corporate control by the financiers. – Early Termination of the Concession: details of the clauses relating to the hypothesis of early termination of the concession contract and the rules for calculating compensation in cases of early termination. – Stopping Points for Truck Drivers: forecast for the implementation of two stopping and rest points. – Stock of improvements: ANTT may request the execution of various improvements (side roads, interconnections, walkways) throughout the contractual execution. |
