To keep pace with technical developments such as artificial intelligence and big data, it is crucial for the EU to create and adopt a legal framework that both promotes innovation and regulates access to and use of data. In order to develop such a legal framework for a data-driven economy and to ensure that it is effective, there is a tremendous need for highly qualified experts in the fields of Intellectual Property (IP) & Data Law. These legal disciplines are instrumental to the EU’s global competitiveness. At the same time, many of the issues raised are closely intertwined with the legal and cultural traditions of the individual member states with regard to the balancing of individual and general interests as, for example, current discussions on waiving patent protection for CoVid19 vaccines and on using personal data for research purposes clearly demonstrate. It is thus vital for students to gain insight into legal traditions, legal cultures and decision-making procedures. The MIPDaL project addresses these challenges by developing a 60 ECTS joint Master`s programme with a tailor-made transnational curriculum that enables students to grasp and manage the complexity of IP & Data Law whilst meeting the requirements for an Erasmus Mundus Joint Master. The programme is developed by a consortium of six prestigious and renowned IP Law institutes from across the EU and the UK. The curriculum includes courses in the core areas of IP law (copyright, patents, designs and trademarks), in the emerging field of Data Law (protection of know-how, data protection, ownership rights in and access rights to data, and competition law with a specific aim of containing the market power of digital gate-keepers) and in related fields so as to build upon a student's existing technical, economic and societal knowledge. Graduates will be well prepared to pursue a PhD degree in IP & Data Law as well as a successful career in governmental and EU agencies, law firms or companies.
