Texas Senate Bill 840 Multifamily Development Law

effective

Texas Senate Bill 840 is a new law that condenses timelines and costs for launching multifamily development in Texas cities with populations over 150,000 in counties with populations over 300,000. It allows multifamily housing to be built by right in areas zoned for commercial, office, warehouse, retail, or mixed use without requiring rezoning approval from local municipalities. The law includes stipulations for density, height, setbacks, and parking, and waives certain fees and studies, but cities retain control over infrastructure, permitting, and design standards.
