Upgrading fundamental rights know-how for Luxembourg

CHARTER UP will strengthen the knowledge and ability of CSOs, rights defenders and legal professionals, to effectively engage in litigation practices at national and EU level and to improve access to justice and enforcement of rights under the Charter. The project will provide training for at least 225 beneficiaries and provide resources to many more, through: • Quarterly Charter Newsletter on case law of Luxembourgish courts and the CJEU • Charter Checklist to check into applicability, relevance and potential new questions • Charter Checkpoint, a hotline for practitioners working on EU rights/Charter cases • Charter case law database (Luxembourgish courts) • 4 one-day seminars on 1) the Charter and its applicability in Luxembourg and 2) the right to effective judicial protection and the remedies before the CJEU with a focus on the preliminary ruling procedure, strategic litigation practices, and specificities of Luxembourg procedural and substantive law • 4 half-day workshops on case studies allowing for exchange of experience on specific topics: asylum, children’s rights, data protection, discrimination • 2 one-day round-tables bringing in experts from other EU Member States with experience in strategic litigation Results • raising awareness on the Charter, its applicability in national proceedings and relevance in individual cases • exchange of practices, understanding the practices of various fundamental rights actors • Increased awareness, knowledge and know-how by legal professionals and practitioners in CSOs, NHRIs, and other rights defenders about EU law, especially the Charter, and relevant remedies and redress mechanisms; • Increased ability of CSOs, NHRIs, and other rights defenders to cooperate, engage, and develop litigation strategies, communicate and advocate around it, and to bring strategic litigation cases before national and EU courts
