Description
Description | The specific objectives of the project are, first, to build the capacity of legal practitioners in the field of asylum and migration to apply the Charter of Fundamental Rights of the EU across all their work. And, second, to strengthen the quality of strategic litigation in the field of asylum and migration. (Focus on cross-border cooperation and on national and European-level litigation using the Charter). The objectives will be implemented by three activities, training and mutual learning; strategic litigation support and research products for litigation. Activity 1, training and mutual learning will consist of a workshop on Charter implementation with 30-40 practicing lawyers and a training visit to the CJEU for approximately 30 practicing lawyers. Activity 2, strategic litigation support will include development of three litigation strategies aiming to assist lawyers from three Member States and covering issues identified in Activity 1. There will be three meetings with lawyers to discuss and elaborate on the strategies (5-10 lawyers per meeting) and five follow-up meetings to provide detailed litigation advice to lawyers on strategy implementation. Finally, support will also include Charter-related litigation advice. Finally, Activity 3, research products for litigation will include jurisprudence mapping to identify domestic case law invoking Charter rights and drafting of summaries of domestic decisions (40 summaries); two legal notes on the Charter rights underused in asylum litigation and research and publication of background material to support Charter workshop and CJEU event as needed. |
