This notice follows the Federal Acquisition Regulation Deviations outlined in the Federal Acquisition Regulation Overhaul as required by Executive Order (E.O.) 14275, Restoring Common Sense to Federal Procurement, signed April 15, 2025. Intent to Sole Source: The Government plans to issue a sole-source, firm-fixed-price contract in accordance with Federal Acquisition Regulations (FAR) 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements , with Boston Scientific Corporation to provide TheraSphere Y-90 Glass Microspheres. This requirement is for ongoing services of providing TheraSphere Y-90 Glass Microspheres at the Jesse Brown VA Medical Center located in Chicago, IL. The services at the facility are necessary to provide targeted radiation therapy using microscopic glass beads containing radioactive Yttrium-90 (Y-90) to treat liver cancers, delivering high-dose beta radiation directly to tumors via the hepatic artery to kill cancer cells while sparing healthy tissue. Services will be from 04/01/2026 through 03/31/2027. The designated source is Boston Scientific at 300 Boston Scientific Way, Marlborough, MA, 01752. In accordance with FAR Part 6, contracts awarded using this authority must be supported by a written justification, and approval will be posted within fourteen (14) days after contract award if the dollar amount meets the threshold. The Government will review all capability statements received by the closing date of this synopsis. The decision not to compete based on responses is solely at the Government's discretion. The information received will be used only to determine whether to pursue a competitive procurement. The applicable North American Industry Classification System (NAICS) code for this work is 325412 - Pharmaceutical Preparation Manufacturing, with a size standard of 1,300 Employees. THIS NOTICE OF INTENT IS NOT A REQUEST FOR COMPETITIVE QUOTATIONS or PROPOSALS. No contract award will be made based on quotations or proposals received in response to this notice. No solicitation document exists, and no telephone or email inquiries will be accepted. Any responsible source that believes it can meet the requirement may submit a capability statement to brandon.harris@va.gov no later than February 25, 2026, at 09:00 AM Central Time (CT).
