Services include maintaining compliance with the Comprehensive Environmental Response , Compensation , and Liability Act ( CERCLA ) related regulatory oversight and technical support for 5 - year review reporting , feasibility study ( FS ), proposed plan , remedy decision , remedial design , and remedial action work ( CERCLA - protective activities ). NDEP is using State authority under Nevada Water Pollution Control Law , mining laws , and hazardous waste laws , NRS 445A , NRS 519 and NRS 459 , to perform regulatory oversight in a manner that is consistent with CERCLA and the National Contingency Plan ( 40 CFR 300 ). Because of the detailed and broad nature of ongoing and future support services required under this contract , a project - specific scope of work is not being provided at this time . Required services are on an “ as needed ” basis at the discretion of NDEP and are dependent upon the amount of site specific CERCLA - protective activities requiring technical support at the ACMS . NDEP will require the selected contractor and their subcontractor ( s ) to be fully prepared to initiate support services described below upon completion of the fully executed contract . Contracted tasks and expenditures will be negotiated on an individual scope of work basis .
