APPRAISAL FOR CONSERVATION EASEMENT

Preliminary Larger Parcel : All rights , title , and interest in and to a 2 , 145 . 08 - acre +/- property and a 5 . 83 - acre +/- property acquired by the Branch Mountain Hunting Club , Inc ., a West Virginia corporation , as recorded in Deed Book 165 , Page 242 and Deed Book 212 , Page 587 , respectively , subject to the following outstanding rights , reservations , benefitting easements , and / or encumbrances ( based upon the legal description and title evidence provided ): EX 1 – A 30 ’ wide easement held by the West Virginia Division of Highways for ingress and egress through the subject property , to the adjoining 5 . 83 - acre property along with the right and obligation to maintain the existing roadway to an existing radio tower located on the subject property that is owned and operated by the West Virginia State Police ( i . e ., Department of Public Safety ), and authorization to co - locate telecommunications equipment on said radio tower . See Deed Book 221 , Page 800 in the Hardy County Clerk ’ s Office . EX 2 – A Plat of Boundary Adjustment for Taxing Purposes between Branch Mountain Hunting Club , Inc . and Bear ’ s Heil , Inc . dated July 2 , 1996 , and recorded in Deed Book 238 , Page 481 in the Hardy County Clerk ’ s Office . EX 3 – A 25 ’ exclusive right - of - way easement conveyed to the Branch Mountain Hunting Club , Inc . providing motor vehicle access to the subject property from WV Secondary Route 11 / 3 , as further described in in Deed Book 205 , Page 739 in the Hardy County Clerk ’ s Office . [ Note – This is a benefitting easement in favor of Branch Mountain Hunting Club , Inc .] EX 4 – A 30 ’ exclusive ( except for the right of use by the original grantor of the easement and their heirs and assigns ) right - of - way easement conveyed to the Branch Mountain Hunting Club , Inc . providing access to the subject property from WV Secondary Route 12 / 1 , as further described in in Deed Book 168 , Page 285 in the Hardy County Clerk ’ s Office . In addition , the Branch Mountain Hunting Club , Inc . was granted the right , but not the obligation , to maintain the roadway located within the described right - of - way easement .
