0 . 1 . Vendor shall supply all labor , tools , transportation , materials , equipment and permits as necessary and required to perform services as described herein . 30 . 2 . Make deliveries in accordance with the delivery days and timeframes set forth herein , except on holidays or at other times when the State is closed , including , but not limited to , inclement weather . All references to the time of day are Eastern Time ( ET ). 30 . 3 . Vendors shall provide material safety data sheets with the delivery of any and all products covered by RSA 277 - A , the “ Worker ’ s Right to Know Act .” 30 . 4 . Delivery shall be made as ordered and in accordance with the terms specified herein . Unless otherwise specified by the State in writing , delivery shall be to a loading dock or receiving platform . The Contractor or Contractor ’ s shipping designee shall be responsible for removal of product from the carrier and placement on the State loading dock or receiving platform . The State receiving personnel are not required to assist in this process . Reasonable compliance with delivery terms shall be final and binding and the burden of proof of proper receipt of the order shall rest with the Contractor .
