Description
Description | Hartlepool Development Corporation (HDC) have awarded a contract to appoint a property manager for Middleton Grange Shopping Centre (MGSC). the contracting authority reserves the right to modify the contract in reliance on Schedule 8 paragraph 5 of the Procurement Act 2023 where the contracting authority considers that a “known risk” has arisen. A “known risk” is a risk which could jeopardise the satisfactory performance of the contract but because of the nature of the risk it could not be addressed in the contract as awarded. The following risks have been identified as known risks Phase 1 redevelopment project not led by HDC – potential impact on the ground in demolition phase particularly requiring the property management function to provide more support than initially envisaged. Previously unidentified asbestos or RAAC is discovered within the centre, resulting in operational restrictions, programme delays or additional requirements that could not reasonably have been identified at contract award, and which require a limited variation to the contract to maintain delivery of the services. A significant change in tenant occupancy levels that materially alters the demand for property management services and requires additional or reduced resources to maintain service delivery. Any resulting contract modification will be limited to the minimum scope, value and duration necessary to address the change in operational requirements. Additional property management requirements may emerge during the contract term as operational needs evolve. Where such requirements could not reasonably have been identified at contract award and are closely connected to the existing services, a limited variation to the contract scope and value may be required to maintain effective service delivery. As a result of this the standstill period will commence on 28th October 2026 and finish at 2359hrs on 6th November 2026. |
