J065 -- Intent to Sole Source : Cepheid Service Agreement

This Notice of Intent is provided to advise that the Government intends to solicit and negotiate a Sole Source , Fixed - Purchase Order with only one source , Cepheid . This procurement is for annual service coverage ( Premier Care and Essential Care plans ) for two GeneXpert diagnostic analyzers . Coverage includes Preventative Maintenance , repairs , parts , labor , module swaps , uptime guarantee , software updates , and loaner equipment per Original Equipment Manufacturer ( OEM ) terms . The period of performance will be for a base year and four one - year options . This action is for service for which the Government intends to solicit and negotiate with only one source under the authority of Revolutionary FAR Overhaul 12 . 102 ( b ) and 41 USC Â § 1901 , only one will meet the Government s needs . Only one source is capable of responding due to the unique or specialized nature of the supplies and / or services . It is the Government s belief that the proposed candidate is the only authorized provider of the reagents that can meet the agency s needs . Interested persons may identify their interest and capability to respond to the requirement . All responsible sources may submit a quotation , bid , or proposal , as appropriate , which will be considered by the agency . This notice of intent is not a request for competitive proposals and no solicitation is available . Any responses received will only be considered for the purposes of determining whether to conduct a competitive procurement in lieu of sole source contract described in this notice , and such determination shall be made at the sole discretion of the Government . Supporting evidence must be furnished in sufficient detail to demonstrate the ability to comply with the requirement . If no responses are received , the government will proceed with the Sole Source acquisition .
