• Contractor ( s ) shall provide live and / or Internet public auction services at the seizure location , the Contractor ( s ) location or Contractor ( s ) specified website or at other locations as specified by KDOR on the date and time agreed to between Contractor ( s ) and KDOR . • Specific items may be removed from the auction or the entire auction cancelled or postponed at any time at the discretion of KDOR with the Contractor ( s ) responsible for public notification . Prior to the auction , items must be able to be retrieved for return to owners if necessary . • Contractor ( s ) shall adhere to KDOR ’ s Employee Tax Sale Policy , which states in part : Pursuant to K . S . A . 60 - 2412 no officer making the sale of property may purchase the property , either directly or indirectly . The Contractor ( s ) is acting as an agent of KDOR in both the logistics in seizing taxpayer ’ s property and in conducting the sale of property seized for tax sales ; therefore , the Contractor ( s ) and its employees may not bid on such property . • Any additional expenses above the auction commission must be pre - approved by KDOR who reserves the right to provide any of these services through other vendors , other internal KDOR groups or other State agencies . • Contractor ( s ) shall have resources available for contact during regular business hours . • Contractor ( s ) shall have or have access to proper licensing for sale and storage of seized assets ( i . e . firearms , CDL , etc .). Contractor ( s ) shall provide advice on the value and salability of assets considered for seizure . • KDOR authorizes Contractor ( s ) to start and move assets to the auction areas and to move items within the auction area for the purpose of arrangement , display or demonstration . Contractor ( s ) shall be the responsible party should any damage be incurred during the movement and auction of assets . Contractor ( s ) shall not move items outside the auction area without prior KDOR approval . • Contractor ( s ) shall arrange all event advertising , event facilities , merchandise cataloging , merchandise storage , and merchandise preparation for sale . • For on - line auctions , Contractor ( s ) shall provide a web site to advertise items and events . The auctioneer shall arrange a picture display of sale items at least seven ( 7 ) days prior to the auction , as well as organize and set up all items to be sold at auction . • For live auctions , Contractor ( s ) is encouraged to provide a web site to advertise items and events . Examples would include collection costs , returned check charges , late payment charges , late pick - up storage fees , shipping and handling fees , rigging and loading fees , and handling fees for non - retrieved merchandise . • By utilizing this contract , KDOR engages the Contractor ( s ) as the agent of the seller for purposes related to the auction . Contractor ( s ) shall have the authority to execute bills of sale to purchasers at the auction and to receive , demand , and collect sale proceeds . • Vehicle Titles will be signed and sent to Contractor ( s ) for dispersal or proper Power of Attorney forms will be provided to Contractor ( s ) staff for title distribution . All titles will be filled out with a buyer ’ s name and photocopied prior to being distributed to buyers . Titles will not be distributed until all reasonable actions have been taken to verify that payments are valid .
