SECTION C SPECIFICATIONS C1 GENERAL INSTRUCTIONS C1 . 1 The intent of this solicitation is to provide multipurpose paper to the Newark Board of Education ( NBOE , District ). Delivery is required throughout the District to all schools and administrative locations ( approximately seventy ( 70 ) locations ). C1 . 2 The conditions and requirements are intended to be open and nonrestrictive and are to serve as standards for the purpose of obtaining adequate participation of interested vendors ; uniformity in the submission of bids , and selection of the most responsible vendors . All items bid shall either meet or exceed the following specifications and industry standards . C1 . 3 The items listed in the RFP / Q - Pricing Spreadsheet section of the electronic bidding platform refers to brand name or equivalent , items of lesser quality will not be accepted ( see G9 Brand Name or Equal ). C1 . 4 Where items are specified by a brand name , it is not the intention of the Newark Board of Education to discriminate against an equivalent product of another manufacturer . C1 . 5 When alternate items are proposed , the bidder shall firmly establish that the offered product meet all of the salient characteristics of the requested brand name . C1 . 6 It shall be the responsibility of the NBOE to determine what is considered an equivalent product , and the determination shall be final . C1 . 7 Whenever possible , products shall be manufactured in the United States . C1 . 8 The District reserves the right to reject any bid in whole or in part ; to waive technical defects , qualifications , irregularities and omissions in accordance with applicable law . Also reserved is the right to reject bids and to purchase items using New Jersey State Contract or a Cooperative in which the District participates , or utilize both . C1 . 9 Award of contract will be subject to the availability of funds . C1 . 10 When the Newark Board of Education is required for any reason to pick - up at the vendor ’ s place of business and deliver , the Contractor agrees to provide a reduction of twenty percent ( 20 %) of the contract price for the item picked up and / or delivered .
