The Contractor shall provide collection services in accordance with all applicable state and federal laws and regulations . The Contractor ’ s personnel shall be and remain knowledgeable of and comply with such state and federal laws , as well as current industry regulations and guidelines . Contractor ’ s personnel shall also provide courteous customer service . The Contractor and anyone acting on its behalf shall not under any circumstances use threats , intimidation , or harassment in the collection process nor violate any guidelines established by the Federal Trade Commission . The Contractor shall implement collection procedures to achieve maximum recovery , regardless of referral volumes . Such collection procedures shall include : a . Initiations of Collection Efforts : The Contractor shall perform the following within five ( 5 ) business days of receipt : i . Download files and establish each Account in the Contractor ’ s system . The Authorized User shall be notified , either directly or through the portal , when files are downloaded and accounts established ; ii . Assign each Account to the appropriate Account Manager and support personnel ; iii . Commence outreach activities consistent with standard industry practices . b . Standard Collection Methods : The Contractor shall use all reasonable and lawful methods of collection , including letters , telephone calls , skip - trace inquiries , and other attempts to locate and contact debtors , to maximize recovery . c . Account Collections : All amounts collected by the Contractor shall be in cash or converted to cash before receipted as a payment and remitted to the State . Payment plans shall not exceed twelve ( 12 ) months , and in no event shall payment plans extend beyond the expiration date of this Contract . A . 6 . Licensure and Memberships . The Contractor shall maintain all licenses , certificates , approvals , registrations , and authorizations as are required by the State of Tennessee and any other state wherein collection activity is being conducted on behalf of the State of Tennessee . The Contractor must be a member of the American Collectors Association . A . 7 . State Collection Fees . To the extent legally allowable , the Authorized User may charge debtors State Collection Fees , which may consist of late charges including interest , service charges , collection costs , and other fees . The Agency Coordinator shall identify and include State Collection Fees with the Account information provided when an Account is placed with the Contractor .
