Description

On 1.1.2016 an amendment to the Belgian law of 22.7.1985 on the civil liability for nuclear damage entered into force (Law No 2014011384, Moniteur Belge 18.7.2014). This amendment implements the Protocol from 2004 which amends the liability regime under the Paris Convention of 1960 on the liability in the nuclear energy field (Paris Convention on third party liability in the field of nuclear Energy (29.7.1960) as amended by the Protocols of 28.1.1964, 16.11.1982 and 12.2.2004). The new legislation increases the liability of nuclear operators and prolongs the prescription period for physical damage caused by a nuclear accident to 30 years instead of 10 years. The law obliges nuclear operators to conclude an insurance contract for their liability under this law. This law is applicable to the JRC Geel site and the JRC is obliged to have a new insurance contract in place before 31.12.2016. The JRC Geel site is recognised as a class I nuclear operator with reduced risk.
