A . It is the intent of these Specifications to describe the minimum level of service required . B . It will be the responsibility of the contractor to dispose of all pre - determined tree removals and fallen trees , including limbs and other debris generated to an off - site facility . C . Stump removal includes grubbing to a minimum of 12 " deep , large roots are to be traced back and removed . All debris shall be removed ; holes shall be backfilled with topsoil , the site reseeded and straw placed over the seed . C . The Contractor shall not engage or use the services of Sub - contractors in performing the Contract unless the Contractor obtains prior approval from the City . D . The Contractor shall provide all equipment , labor and other materials necessary to perform the services indicated . E . Payment for work completed shall be conditioned upon the approval of the Park Maintenance Crew Leader or the Superintendent of Maintenance . The Contractor shall submit an invoice itemizing services provided to the City of Crestwood at the end of each completed cycle . Upon approval of the work , Contractor will receive payment within thirty ( 30 ) days . F . The Contractor shall be held responsible for any damages , breakage and / or loss of the City ' s signs , buildings , utilities , or any loss incurred to adjacent property , buildings , vegetation , or fences through the actions of the Contractor or his / her employees while working on the City ' s premises . G . The City of Crestwood assumes no liability for personal injury or property damage resulting from the performance of the work . H . It is understood that the Contractor is an independent contractor and neither Contractor nor its employees shall represent themselves as either employees or agents of the City of Crestwood . Any person employed by the Contractor who , in the opinion of the City representative ( s ), does not perform satisfactorily or is intemperate or rude to residents or employees of the City shall , at the written request of the City , be removed from further employ in any portion of the Contract work . SAFETY A . Proper safety precautions are to be observed at all times . B . All vehicle and equipment use shall be according to OSHA requirements and local and state law . C . Appropriate traffic control signs and practices shall be used when working within any street right - of - way .
