1 . 0 GENERAL DESCRIPTION : The County of Somerset is soliciting bids to establish multiple contracts for the purchase of Unleaded Automotive Gasoline ; Regular Unleaded 87 Octane , Mid - Grade Unleaded 89 Octane and Premium Unleaded 93 Octane for Somerset County and its Cooperative Membership . The intent of this bid is to award contracts to those responsible bidders whose bid proposals , conforming to this bid are most advantageous to Somerset County and to the Somerset County Cooperative Membership . This contract shall include a primary and secondary vendor for each County . 2 . 0 CONTRACT TERM : 2 . 1 The term of this contract shall be awarded for ( 2 ) two years . 2 . 2 In the event that a new contract has not been awarded prior to the contract expiration date , as may be extended herein , it shall be incumbent upon the contractor to continue the contract under the same terms and conditions until a new contract can be completely operational . At no time shall this transition period extend more than 120 days beyond the expiration date of the contract . 3 . 0 CONTRACT SPECIFIC DEFINITION : 3 . 1 Upcharge / Down charge – An upcharge consists of all costs associated with the delivery of the fuel to the site , including but not limited to labor , profit , delivery charges , to be added to the fuel prices . A downcharge is the same except it is subtracted from the fuel prices . 4 . 0 GASOLINE SPECIFICATION : 4 . 1 All gasoline supplied under this contract shall conform in every respect to all standards and regulations established by Federal and New Jersey State laws . 4 . 2 Gasoline supplied under this contract shall comply with the requirements of Federal Specifications for Gasoline , Automotive , Leaded or Unleaded , VV - G - 1690C , January 1982 , Classes C , D , E , and any amendments thereto , Standard Specification for Automotive Spark - Ignition Engine Fuel , New Jersey Department of Environmental Protection " Control & Prohibition of Air Pollution by Vehicular Fuel , NJAC Title 7 , Chapter 27 . 5 . 0 QUANTITIES : 5 . 1 The quantities provided are not binding for Somerset County and the Cooperative Membership . The right is reserved to order any quantity necessary to meet Somerset County and the Cooperative membership requirements . No guarantee is made by Somerset County or its Cooperative Membership to purchase any amount of product . 5 . 2 For bidding purposes , it is estimated that Somerset County and Somerset County Park Commission uses approximately 600 , 000 gallons of gasoline per year . Cooperative Membership estimated quantities may be viewed in section 13 . 0 with locations and tank size , and shall not be bound to any estimated quantities indicated . This is an Open End contract , and upon mutual agreement between Somerset County ( Lead Agent ) and the successful bidder ( s ) ( Contractor ) use of this contract may be extended to additional registered members pursuant to approval by the Lead Agency ( Somerset County ) and the Contractor ( s ). 5 . 3 Contractors may be required to service additional locations , which may be added to the contract during its term . The additional locations will adopt the prices and contractor that services an existing location in the same vicinity . 6 . 0 DELIVERY : Unless otherwise indicated herein , the following requirements shall be provided : 6 . 1 Deliveries shall be made within ( 24 ) hours following the receipt of an order or verbal notification by Somerset County or the Cooperative Members . 6 . 2 Emergency deliveries shall be made upon receipt of verbal notification from Somerset County or Cooperative membership . 6 . 3 Deliveries shall be FOB destination . 6 . 4 Deliveries will be accepted between the hours of 7 : 30 AM and 4 : 00 PM seven days a week , holidays excepted , unless otherwise agreed upon by the entity Somerset County or the Cooperative Membership and the contractor . 6 . 5 In the event the bidder proposes to use subcontractors for the actual servicing , the names of the subcontractors shall be required for approval as part of the bid response . Somerset County reserves the right to inspect their facilities in order to determine their ability to satisfactorily perform under delivery conditions set forth herein . 7 . 0 INSPECTION : 7 . 1 Somerset County and its Cooperative Membership reserve the right to have all measuring devices checked and rechecked , at any time during the life of the contract . 7 . 2 If rechecks disclose any discrepancy in the number of gallons shown on the delivery ticket and the actual number of gallons delivered , use of such equipment will not be permitted until certification has been received from the New Jersey Weights and Measures Bureau that the measuring device is accurate , or has been corrected .
